By accessing or using the services provided by Benrose Services Company Limited ("we", "our", or "us"), including our website, telecommunications services, M-PESA processing, and professional sourcing solutions, you agree to be bound by these Terms of Service. Benrose Services Company Limited provides various B2B and B2C services, including but not limited to:

• Safaricom outlet management and telecommunications support.
• Registration and activation of Safaricom and M-PESA-enabled lines.
• Provision of Bulk SMS solutions and digital communication tools.
• Retail and corporate supply of genuine mobile devices and accessories.
• Sourcing and management of professional business services.

3. Third-Party Services & Safaricom PLC

As an authorized Safaricom dealer, many of our core services (such as M-PESA line activation and network services) are subject to the operational guidelines, regulatory requirements, and independent terms of service established by Safaricom PLC and the Central Bank of Kenya (CBK). By utilizing these specific services through us, you also agree to comply with Safaricom's respective terms and conditions.

4. Client Responsibilities

When engaging with our services, you agree to:

• Provide accurate, current, and complete information, especially regarding business registration and identity verification required for financial telecommunications.
• Use our services, including Bulk SMS, in strict compliance with Kenyan communication and data protection laws (e.g., no spam, malicious content, or unauthorized marketing).
• Maintain the confidentiality of any account credentials or system access provided by us.

5. Intellectual Property

All content, branding, website design, and proprietary service frameworks provided by Benrose Services Company Limited remain our exclusive intellectual property. Third-party logos (such as Safaricom) are the property of their respective owners and are used under authorized dealership agreements.

6. Limitation of Liability

To the maximum extent permitted by applicable law, Benrose Services Company Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, resulting from your use of our services, network downtimes, or third-party service interruptions.

7. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the Republic of Kenya. Any disputes arising from these terms or our services shall be subject to the exclusive jurisdiction of the Kenyan courts.
